Fotis Dulos Attorney Says Girlfriend Passed Polygraph Test - New Canaan, CT Patch

NEW CANAAN, CT — Michelle Troconis, the girlfriend of estranged husband Fotis Dulos, recently passed a polygraph test that could help Fotis Dulos in connection with the case involving the disappearance of his wife, Jennifer Farber Dulos, according to attorney Norm Pattis.

In a radio interview Thursday morning with Chaz and AJ on 99.1 WPLR, Pattis said that Fotis Dulos "did not cause his wife to disappear or cause her harm," but also said that he believes Jennifer Dulos may have been the victim of foul play. Listen to the interview below.

But Troconis has been ruled out as a participant in any foul play that may have taken place in New Canaan, according to Pattis, in part because of the polygraph she passed. She has also provided an alibi that has "satisfied police."

In the arrest warrants for Troconis and Fotis Dulos, authorities state that Jennifer Dulos was the victim of a "serious physical assault" at her New Canaan home at the time of her disappearance.

While Troconis has met with prosecutors, Pattis believes that she has not provided authorities with any information of value, which could help his client because she also told police she had no knowledge of what may have been in the bags she and Fotis Dulos are accused of discarding.

Police said the two threw away bags in Hartford that contained items stained with Jennifer Dulos' blood.

The Hartford Courant reports that black Ford F-150 Raptor pickup truck, that police said Fotis Dulos was driving when items were discarded in Hartford, was seen in New Canaan on May 24, the day Jennifer Dulos disappeared.

Fotis Dulos reportedly was not driving it at the time - an unnamed employee of his home-building company was - and the truck has been seized by authorities.

Pattis has private investigators working on the case, he said, and his law firm and Fotis Dulos are establishing his alibi for the morning of the 24th. Previously, Pattis said Troconis and her attorney, Andrew Bowman, have not spoken to him or Fotis Dulos.

Authorities continued their search this week for Jennifer Dulos, and for clues to her disappearance, at a pond in Avon and at the Hartford garbage plant where discarded items may have ended up.

One of the key reasons a polygraph is not called a lie detector test is because the results aren't as simple as pass or fail. Many security clearance applicants find themselves with inconclusive test results. What does that mean?

First, keep in mind inconclusive polygraph results aren't necessarily a bad thing. Because a polygraph can't really tell if you're lying – it simply measures physiological response to fact-based questions – a number of factors could result in inconclusive results. So if you find your your initial polygraph exam was inconclusive, don't panic – you should be given another opportunity to take the test.

Some security clearance applicants may be asked to take a second, or even a third polygraph in an attempt to get conclusive results. If you were nervous before your first test (something that should have been established by control measures at the beginning of the interview), you may be more relaxed and prepared upon follow-up examinations.

If your polygraph remains inconclusive, that doesn't necessarily mean you won't get the job. But the government may look to see what continued to cause the inconclusive results, whether it was a medication, or a specific issue that caused red flags in the examination. Remember, a polygraph itself is rarely the reason for a security clearance denial, but may be a factor if you have several character red flags in your background. The polygraph examination is most often used to tease out information you may have failed to disclose in your initial SF-86. Make sure you are up front and honest in your security clearance application, review the answers you provided on your questionnaire, and you will be prepared for any questions the polygraph exam may ask.

A lawyer for Fotis Dulos, the estranged husband of missing Connecticut mom Jennifer Dulos, on Thursday claimed his client's girlfriend has been ruled out by police as a suspect in any "foul play" after taking a polygraph test and offering an alibi.

Fotis and his gal pal, Michelle Troconis, were arrested earlier this month after investigators allegedly caught them dumping bags containing clothes and cleaning products splattered with Jennifer's blood.

But in a radio interview Thursday, Fotis' attorney claimed Troconis has since passed a polygraph exam in which she said she didn't know what was in the bags — and has an alibi for the time of Jennifer's disappearance.

"My understanding is … the police have ruled her out as a participant in any foul play in New Canaan," attorney Norm Pattis told WPLR.

"My understanding is she's taken a polygraph exam on the question of whether she had any knowledge of any foul play or disposal of evidence and she satisfied police in that polygraph exam and she provided an alibi."

He added: "It's my understanding that she sat a polygraph saying she didn't know what was in any of those bags."

Troconis has been speaking with investigators in the case since she was bailed out, but Pattis said he doesn't think she's given police "anything of value."

Pattis wouldn't comment on Fotis allegedly dumping the bags, saying only: "If there was material with Ms. Dulos' blood or a sponge or evidence of a cleanup in my clients' possession, we are investigating how that might have happened."

He insisted his client didn't "cause his wife to disappear or cause her harm."

Jennifer vanished on May 24, and police later found bloodstains inside the garage of her New Canaan home indicating the mom of five was beaten there, according to court documents.

Investigators allege Fotis and Troconis later stopped at more than 30 locations near Hartford, dumping items splattered with Jennifer's blood in roadside trash cans.

Both have been charged with evidence-tampering and hindering prosecution in the case and are now out on bail.
