ANNAPOLIS — Del. Mike McKay tried Tuesday to convince the House Judiciary Committee to back a bill to change the requirement that potential state correctional officers undergo lie-detector tests. McKay’s bill is an attempt to reduce the number of vacancies among correctional officers, which legislative analysts currently estimate at nearly 20 percent statewide. It would not eliminate polygraph tests altogether, but would let corrections officials to either require the test or a more extensive background check — or both. “We believe these six words, ‘or extensive background check, or both,’ will begin to address our staffing shortage,” McKay, R-Washington/Allegany, said. The bill — co-sponsored by Del. William Wivell, R-Washington — got a mixed reaction from committee members, several of whom wondered whether the polygraph requirement could simply be scaled back. ANNAPOLIS, Md. - Two Delegates from Washington County have put forward a bill that would make polygraph tests optional for correctional officers in state prisons.  Correctional vacancies in the Department of Public Safety and Correction Services have increased from two percent to around 20 percent over the past six years.  "We have heard just a lot of cases in the way the polygraphs are being administered that keeps a lot of good folks from being hired," said Del. Wivell. "So, hopefully will ease into the hiring process, so we are able to hire those vacancies."  Under the current law, an applicant for a position as a State correctional officer could conduct a a polygraph examination before being appointed to the position. But, an employer in the State "may not require or demand, as a condition of employment, prospective employment, or continued employment, that an individual submit to or take a lie detector or similar test." BERRIEN COUNTY, Mich. -- The wife of Tyrone Hassel III admitted to investigators she and her boyfriend planned to kill her husband while they were in Michigan on leave, according to court records. Kemia Hassel and Jeremy Cuellar have been charged with murder in the fatal shooting of Tyrone Hassel III on New Year's Eve. Around 11 p.m. on December 31, Tyrone was shot outside his parents' home on Colfax in St. Joseph Township. He had been shot in the head, neck and torso. Tyrone was transported to the hospital where he was later pronounced deceased. Through the investigation and tips, officers developed Kemia as a suspect in her husband's murder. On January 11, 2019, Kemia spoke with investigators. She denied being involved in Tyrone's murder and took a polygraph. Police said she failed the polygraph. A Superior Court judge has reversed her decision and said Waterbury village did not break the law when it fired a police officer in 2012. The case of Adam Hubacz v. Village of Waterbury has spent the past six years winding its way though federal and state courts. In a decision issued in April, the Vermont Supreme Court ruled that the village’s trustees acted appropriately, and sent the case back to Washington County Superior Court for a fresh look, in light of the justices’ decision. In December, Superior Court Judge Mary Miles Teachout followed the guidance offered by the Supreme Court and reversed her previous decision. “The village lawfully terminated Mr. Hubacz’s employment,” Teachout wrote as part of a four-page decision. According to Supreme Court documents, the case began when Hubacz — who joined the Waterbury Police Department in 2009 — applied for a job with the St. Albans Police Department. House Bill 12 proposes having candidates take a polygraph test "and/or" an extensive background check.  Western Maryland Delegate Mike McKay says he sponsored the bill after hiring correctional officers did not go past single digits in his district.  "And the number one issue that kept coming up was the polygraph, the polygraph.
